Terms of Service
1. Who these terms are between
These terms apply between Wildcat Websites, a one-person web design business based in Kentucky ("I," "me," "my"), and any business or person who buys a plan or service from me ("you," "your," "the client").
By hiring me, you agree to these terms. If we sign a separate written agreement for your project, that agreement controls wherever it differs from this page.
2. What I provide
I design, write, build, host, and maintain small business websites. The specific pages, features, and support level depend on which plan you buy. Current plans and what's included are listed on the pricing page.
A quote is an offer, not a contract. Nothing is owed by either of us until you accept a quote in writing and pay the deposit.
3. Scope, revisions, and changes
Your quote states the number of pages and the features included. Work outside that scope is quoted separately, at a flat price, and only begins after you approve that price in writing.
Revisions: every build includes two full rounds of revisions before launch. You'll receive a private preview link, and nothing goes public until you approve it.
Unlimited small edits after launch are included with every monthly plan. A "small edit" means any change that takes me under 20 minutes — text changes, swapping a photo, updating hours or prices, adding a staff member, changing contact details, seasonal announcements. Email or text them over and they're done within 2 business days.
Larger work — a new page, a redesign, a new booking system, a fresh round of photography — is not a small edit. I'll quote it at a flat rate before starting. You will never receive an invoice you didn't approve first.
4. Payment
- Setup fee: half up front to begin work, half when the site goes live.
- Monthly plan: begins the month after launch and continues until you cancel.
- Accepted payment methods: Venmo, Cash App, or PayPal.
- Annual option: pay twelve months up front and receive two months free.
Sales tax: Kentucky applies sales tax to website design, development, and hosting services. Where it applies, tax is added to your invoice and is not included in the prices shown on this site.
If a monthly payment is more than 15 days late, I'll email you. If it reaches 30 days late, I may suspend hosting and support until the balance is paid. I'll always contact you before anything is suspended — no site goes dark by surprise.
5. What you're responsible for
To build your site on schedule, I need from you:
- Accurate information about your business, services, and pricing
- Your logo and any photos you want used, or permission to use licensed stock
- Timely feedback on the preview link
- Final approval before launch
You confirm that any text, images, logos, or other material you send me is yours to use, or that you have permission to use it. If a third party claims otherwise about material you supplied, that's your responsibility, not mine.
Timelines assume you respond within a reasonable time. If a project stalls waiting on your materials or approval, the launch date moves accordingly.
6. Timelines
Most sites go live seven days after the kickoff call. That's my normal pace, not a contractual guarantee — the most common cause of delay is waiting on photos, logos, or feedback from the client.
Quote requests are answered within one business day. Small edits are completed within 2 business days.
7. Who owns what
You own, always and outright:
- Your domain name, which you purchase directly in your own name
- Your business name, logo, and brand
- All text, photos, and content you provided
- The copy I write for your site, once the setup fee is paid in full
I retain the right to reuse general code, layout techniques, and components I develop, on other projects. Your specific design and content are yours; the underlying craft is mine to keep using.
Portfolio use: I'd like to show your finished site as an example of my work. If you'd rather I didn't, just say so and I won't — no explanation needed.
8. Hosting and third-party services
Hosting and an SSL certificate are included in your monthly plan. I use reputable third-party providers for hosting and form delivery.
I'll do everything reasonable to keep your site online, but I don't control those providers and can't guarantee uninterrupted service. If your site needs a paid third-party tool — an appointment booking platform, an email marketing service — that subscription is billed to you by that company under their own terms.
9. What I don't guarantee
I do not guarantee search rankings, traffic volume, leads, or sales. I do the technical groundwork that makes ranking possible — fast load times, proper page titles and descriptions, structured data, a sitemap submitted to Google, mobile-friendly layout. What Google does with that is Google's decision. Anyone who guarantees you a #1 position is guessing.
10. Cancellation
There is no contract and no cancellation fee. You can cancel your monthly plan at any time by emailing or texting me.
When you cancel:
- Hosting, edits, and support continue through the end of your current billing period
- I export a complete copy of your site files and send them to you
- You keep your domain, your content, and your brand
- Already-paid fees are not refunded, including any prepaid annual balance
I may end a working relationship if a client is abusive, repeatedly fails to pay, or asks me to publish content that is illegal, deceptive, or infringing. In that case I'll give you your files and we'll part ways.
11. Acceptable use
I won't build or host sites for content that is illegal, fraudulent, defamatory, infringing, or intended to deceive people. I also won't publish fabricated reviews or testimonials, or claims about your business that aren't true. This isn't negotiable — it protects both of us.
12. Limitation of liability
I'll do careful, professional work. But to the fullest extent permitted by Kentucky law, my total liability for any claim arising out of our work together is limited to the amount you paid me in the twelve months before the claim.
I'm not liable for indirect or consequential losses — lost profits, lost business opportunities, or lost data — arising from website downtime, third-party service failures, or search engine ranking changes.
13. Governing law
These terms are governed by the laws of the Commonwealth of Kentucky. If we ever have a dispute we can't resolve by talking it through, it will be handled in the Kentucky courts.
Honestly: I'd much rather solve a problem with a phone call. If something isn't right, call me first.
14. Changes to these terms
I may update these terms as the business changes. The current version always lives on this page with the date at the top. If a change materially affects an active client, I'll email you about it rather than quietly editing the page.
